Washington DUI Case Results

Aaron's Story (Department of Licensing v. Aaron)

Outcome:  Dismissed

Description:  Department of Licensing sought a 90 day license suspension action against B.'s license to drive based on a blood alcohol content of .22 grams per 100 milliliters.  A.B. was stopped by the Bothell police for speeding and driving his car on the "C" curbing that divides the opposing lanes of traffic.  Open containers were found in the car.

Upon exiting the car the A.B. became entangled with the seatbelt and had to use the car to brace himself.  The officer requested that B. remove the cigarette that dangled from his lower lip by disposing of it in the ash tray. A.B. threw the cigarette at the officers feet and snubbed it out with his toe.
