Outcome: DUI reduced to Reckless Driving with no jail
Description: Marin was stopped in a Casino parking lot after almost striking another car. She drove through a stop sign but a collision was avoided by the other driver.
The officer who had been watching her driving testified at a motions hearing to her horrible driving. She performed poorly on the field sobriety tests, showed large emotional swings including crying and asking for her mother. At the station she provided a breath sample that was over a .12. The officer quoted her as confessing to multiple drinks throughout the evening including shots. Discussions with the officer included the reason she felt sad - her boyfriend had broken up with her.
Although most of the motions we raised failed we continued to litigate the case and eventually found that the video from the officer had been withheld. Marin now is happily moving on with her life and looking new a boyfriend.
