Roshana's Licensing Case (Department of Licensing v. Roshana)
Outcome: Case DISMISSED! Roshana keeps her license.
Description: Roshana was driving with her headlights out when the Officer pulled up behind her and activated his emergency lights. She pulled to the right but still blocked the right lane of traffic when she stopped.
The Officer noted that she was cooperative, had fair coordination, was orderly, but had watery and bloodshot eyes with medium odor of alcohol, and slurred speech.. He could smell more and more intoxicants as he waited for her to provide her license. She admitted coming from a party and drinking. Roshana agreed to do field sobriety tests, which she failed.
At the precinct she provided a .124 and .126 breath test sample.
We were able to convince the hearing examiner that the breath test did not meet the statutory protocol. Case dismissed.
