Outcome: Possession of Marijuana and Drug Paraphernalia DISMISSED
Description: Possession of Marijuana and drug paraphernalia. Case was dismissed by the judge after we challenged the legality of the arresting officer.
Rick and his friends were on their way home from a concert at the Gorge. While traveling on I-90 through Cle Elum, they were stopped for speeding. The Washington State Patrol Trooper immediately pulled Rick and his friends out of the car one by one and began interrogating them about using marijuana. One of Rick's friends said that the pot and pipe belonged to Rick and as a result, Rick was charged with possession of Marijuana and Drug Paraphernalia. Yes, this was long before Initiative 502 made Marijuana legal.
To makematters worse, Rick was on probation for a DUI that had been reduced to reckless driving and was a facing a significant violation which almost certainly included jail time. We were able to help Rick. We successfully achieved a dismissal of the charges by proving that Rick was arrested and searched in violation of his Constitutional rights. Additionally,Rick's probation was not revoked because of the Constitutional violations.
