Tom's Story (State of Washington v. Tom)
Outcome: Resisting Arrest charge dismissed, DUI reduced to Reckless Driving with no jail and community service credit for all fines.
Description: Tom was charged with DUI and Resisting Arrest after a collision with another car. The officer took him down to the ground when Tom walked away and urinated in a dark alley in Seattle. Tom had performed poorly on the field sobriety tests prior walking over to relieve himself. Tom resisted the officer while his pants were undone so he was cuffed and placed on the ground, in the dirt, without his trousers covering him.
We were able to challenge the breath test evidence and the basis for the officers use of force. The negotiated resolution made Tom happy and he's back to his life as a student.
